BJD MP Sasmit Patra Calls for National Commission for Scheduled Tribes’ Inquiry into Police Excesses in Sijimali, Odisha

BJD MP Sasmit Patra Calls for National Commission for Scheduled Tribes’ Inquiry into Police Excesses in Sijimali, Odisha

Bhubaneswar, April 12: BJD MP Sasmit Patra has written to the National Commission for Scheduled Tribes (NCST), urging an inquiry into recent incidents in the Sijimali, Rayagada district,Odisha. The MP raised serious concerns regarding police excesses and violations of the rights of the Scheduled Tribe communities in the area.

Patra highlighted that clashes have occurred between local tribal communities and police forces, particularly in connection with a proposed bauxite mining project and related infrastructure developments, such as road construction. These confrontations have reportedly resulted in injuries to both tribal men and women, as well as police personnel.

He expressed his concerns and pointed out several constitutional and legal issues arising from the situation:

  • Violation of the Scheduled Tribes and Other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006: The MP emphasized the non-compliance with provisions safeguarding the rights of Scheduled Tribes under this act.
  • Breach of the Panchayats (Extension to Scheduled Areas) Act, 1996 (PESA): Specifically, Patra noted the failure to obtain the free, prior, and informed consent of the Gram Sabhas as required by law.
  • Infringement of protections under the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989: Patra expressed concern that the use of excessive force against tribal communities could potentially violate protections against atrocities provided by this Act.

In light of these issues, the BJD MP urged the NCST to initiate an immediate inquiry into the matter and send a high-level fact-finding team to Sijimali to investigate the alleged police brutality and procedural violations.

Patra also called on the Commission to utilize its powers under Article 338A(8) to summon relevant records, question officials, and ensure accountability. He emphasized the importance of assessing compliance with both the Forest Rights Act (FRA) and PESA, particularly regarding the legitimacy of the Gram Sabha processes.

Additionally, Patra requested that the Commission recommend interim measures, such as the suspension of coercive police actions and the protection of the affected tribal communities.

He urged the NCST to give urgent attention to the matter and take necessary actions to address the concerns raised.Bottom of Form
