Supreme Court Overturns Illegal Termination of Ex- IAF Official After 32 Years, Restores His Honour

The Supreme Court on Wednesday annulled the wrongful termination of a former Indian Air Force (IAF) official, R. Sood, who had been dismissed from service over 32 years ago. The Court ruled in favour of reinstating his honours in a case concerning the alleged use of criminal force against a junior colleague.

​​​​​​​NEW DELHI, April 15: The Supreme Court on Wednesday annulled the wrongful termination of a former Indian Air Force (IAF) official, R. Sood, who had been dismissed from service over 32 years ago. The Court ruled in favour of reinstating his honours in a case concerning the alleged use of criminal force against a junior colleague.

A bench comprising Justices Dipankar Datta and K. V. Viswanathan concluded that the punishment imposed on Sood, a former squadron leader, was disproportionate. The Court noted that while Sood had been dismissed on September 22, 1993, for the incident, his commanding officer, a Wing Commander whose orders Sood had followed, was given lenient treatment.

The bench observed, "...justice demands that the ignominy with which the appellant (Sood) had to endure for the past more than three decades is erased, the wrongful termination be revoked, and his honour restored." It further added, "The dismissal order dated September 22, 1993, is hereby set aside."

The ruling marks a significant step in ensuring justice for individuals subjected to unfair disciplinary actions, restoring not only the individual's position but also their dignity.
