Former editor Tarun Tejpal surrenders before Goa court
Former Tehelka editor-in-chief Tarun Tejpal presented himself before a Mapusa court in Goa on Monday. This action complies with a strict Supreme Court directive requiring his immediate surrender before considering his appeal regarding a 2013 rape conviction. High-profile cases involving influential media figures often undergo intense legal scrutiny, reflecting India's evolving judicial approach to workplace sexual violence. These legal proceedings stem from accusations made by a female journalist. She reported sexual assault inside a hotel elevator on November 7 and 8, 2013. Authorities originally arrested Tejpal on November 30 of that same year.
Last month, the highest court firmly rejected Tejpal's request to avoid custody. Justice Alok Aradhe mandated a formal surrender within three weeks. Tejpal must now submit a valid surrender certificate to the judicial bench. Providing this crucial proof ensures his criminal appeal will face a formal hearing on September 22.
Senior Advocate Kapil Sibal argued strongly for Tejpal during previous hearings. Sibal claimed the judiciary holds discretionary power to hear the appeal without requiring physical surrender. He emphasised that the current situation involves challenging the Bombay High Court's decision to reverse an earlier acquittal.
Solicitor General of India Tushar Mehta vigorously opposed this request on behalf of the Goa government. Mehta highlighted the gravity of the Bombay High Court findings. He reminded the bench that the case involves an aggravated sexual offence resulting in a severe sentence of 10 years of rigorous imprisonment. Justice Aradhe ultimately dismissed the exemption request, instructing both sides to focus purely on the surrender timeline and mandating the three-week compliance period. Legal experts continue to watch this development closely to see how the highest court handles the impending appeal process next week.
