SC likely to hear pleas challenging ‘Places of Worship Act’ on December 12

New Delhi, December 7: The Supreme Court has constituted a special three-judge bench to hear a series of Public Interest Litigations (PILs) challenging the validity of certain provisions of the 1991 Places of Worship (Special Provisions) Act.

The law prohibits the filing of lawsuits aimed at reclaiming a place of worship or altering its character from what existed on August 15, 1947.

The bench, comprising Chief Justice Sanjiv Khanna, Justice Sanjay Kumar, and Justice K.V. Viswanathan, is expected to hear the matter on December 12 at 3:30 PM.

Among the pleas before the court is one filed by lawyer and activist Ashwini Upadhyay. He has sought the annulment of Sections 2, 3, and 4 of the Act, arguing that these provisions infringe upon the right to judicial remedy. Specifically, Upadhyay contends that the law denies individuals or religious groups the right to reclaim places of worship through legal channels.
