"Old law was not compatible with Indian system": Odisha law minister welcomes new criminal laws

Bhubaneswar, June 27: Odisha Law Minister Prithviraj Harichandan recently welcomed the implementation of new criminal laws in India.

 According to him, the old laws were not compatible with the Indian system. These new criminal laws, which will come into force on July 1, 2024, replace the earlier criminal laws, including the Indian Penal Code 1860, the Code of Criminal Procedure 1973, and the Indian Evidence Act 18721. 

The three new laws are as follows:

Bharatiya Nyaya Sanhita, 2023: This law will have 358 sections (instead of the 511 sections in the IPC). It introduces 20 new crimes and increases the imprisonment sentence for 33 of them. The fine amount has also been increased in 83 crimes, and mandatory minimum punishment is now applicable to 23 crimes.

Bharatiya Nagarik Suraksha Sanhita, 2023: Under this law, police custody under general criminal laws has been extended from 15 days to 90 days, depending on the nature of the offense. It will have 531 sections (replacing the 484 sections of the CrPC). Additionally, 177 provisions have been changed, and new sections and sub-sections have been added.

Bharatiya Sakshya Adhiniyam, 2023: This law will have 170 provisions (instead of the original 167 provisions). It introduces two new provisions and six sub-provisions while repealing or deleting six provisions from the previous bill.

These reforms mark a significant shift in priorities, emphasizing crimes against women, children, and the nation, unlike the colonial-era laws that prioritized concerns like treason and treasury offenses over the needs of ordinary citizens.
