2nd National Mediation Conference: Enhancing the eco-system for mediation in India

Bhubanewswar, Sep 28: The interactive session–II of 2day-National Mediation Conference focused on enhancing the eco-system for mediation in India. This session deliberated upon sector-specific mediation and skill & process-orientation. 

This session was chaired by Justice B.V. Nagarathna, Judge, Supreme Court of India and co-chaired by Justice N. Kotiswar Singh, Judge, Supreme Court of India and Justice Gurmeet Singh Sandhwalia, Chief Justice, High Court of Himachal Pradesh.

In sector-specific mediation key aspects like Mediation in Environmental & Climate Disputes: Resolving conflicts relating to land, water, and sustainability, Mediation in Healthcare & Medical Negligence: Balancing patient rights and institutional challenges,  Mediation in Intellectual Property rights Matters (IPR) related to copyright, trademark, and patent disputes, through mediation were discussed in detail.

 Need for Mediation in Corporate Governance sectors like boardroom conflicts, shareholders disputes, and start-up ecosystem, Mediation in Public Policy & Government Contracts: Bridging the gap between state authorities and private entities and Restorative Justice & Mediation: Applying mediation principles in criminal justice and juvenile cases were deliberated upon. 

In Skill & Process-Oriented Sector Mediation was impressed upon in issues of psychology of Conflict: Understanding human behaviour, emotions, and negotiation strategies, Negotiation & Persuasion Techniques: Practical exercises for mediators,  Ethics & Confidentiality in Mediation in  Handling sensitive information and  Drafting Settlement Agreements: Ensuring enforceability and legal soundness.

Justice B V Nagarathna stated that Mediation is the process to serve human conflict by laws. To address the environmental disputes and for sustainable environmental solutions "Green Mediators" are required. Similarly, for addressing the company matters in this IPR régime, "Specialized Mediators" are required. Elimination of fear factors and enhancing the flexibility in the process makes mediation easier.

Other dignitaries participated in the discussion were Justice Jayant Banerji, Judge, High Court of Karnataka, Birendra Saraf, Advocate General, Maharashtra, Praful N. Bharat, Advocate General, Chhattisgarh and Senior Advocate Jawad A.J. stressed upon the lawyers efficiency in mediation and put emphasis on professional training to Lawyer for the mediation process. They also focused on the proper institutional framework for the future of mediation.
