New Delhi, January 8: The Delhi High Court has ruled that a wife’s earning capacity cannot be assumed during the interim maintenance stage.

Justice Swarna Kanta Sharma made this observation while hearing a woman’s appeal against a family court order, which had granted her Rs 2,500 per month as interim maintenance.

The husband had argued that the wife was employed as a nursery teacher and thus earning. However, he failed to provide any documentary evidence to support his claim.
