New Delhi, June 2: The Supreme Court on Tuesday agreed to consider a significant legal question—whether a government employee can be removed from service for failing to disclose educational qualifications higher than those prescribed for a particular post.

The issue arose from a case involving a Scheduled Tribe employee whose services were terminated after authorities found that he had not revealed that he had passed the Intermediate examination while applying for the post of Work Assistant, for which the minimum educational requirement was Class 10.

A Bench comprising Justices P.S. Narasimha, Aravind Kumar and Shree Chandrashekar issued notice to the Central government on a petition filed by Pawar Subhash, challenging a Telangana High Court judgment delivered on November 27, 2025.

The High Court had upheld the Centre’s decision to terminate Subhash’s employment on the ground that he had suppressed material information regarding his educational qualifications during the recruitment process.

The apex court will now examine whether non-disclosure of a higher qualification, when the prescribed eligibility criterion is lower, constitutes sufficient grounds for dismissal from government service.

The matter is expected to have wider implications for public employment and recruitment practices across government departments.
