Bhubaenswar, June 1: The Supreme Court on Saturday upheld the Orissa High Court’s Order and directed the Odisha Public Service Commission (OPSC) to pay Rs 1 lakh compensation to the candidate who suffered a lot due to the faulty evaluation of the OJS Exam 2022 papers.
Dismissing the appeal filed by the OPSC against the Orissa High Court’s ruling, the Apex Court in its order asked the commission authorities to pay Rs 1 lakh as compensation to petitioner Jyotirmayee Dutta, who failed to qualify the exam due to critical error in evaluation of the answer sheets.
A bench of Justices of the Supreme Court comprising Surya Kant, Dipankar Datta, and Vijay Bishnoi dismissed the OPSC's appeal and delivered sharp remarks on the irresponsible exam system of the commission.
The case came up with the September 2022 Odisha Judicial Service (OJS) Examination for Civil Judge recruitment.
Candidate Jyotirmayee Dutta appeared the written test, and her final score remained just 5 marks short of the viva voce (interview) cut-off.
Meanwhile, Dutta discovered a critical error in which evaluators had completely skipped up one of her right answers in the answer paper. Acting on it, she moved the Orissa High Court seeking re-evaluation of her papers.
Consequently, on the order of the Orissa HC, an independent probe was initalted that confirmed the mistake righteously found out by Dutta. Acting on it, the High Court ordered Rs 1,00000 compensation to the petitioner.
Challenging the order, the OPSC had moved the SC, pleading its evaluation process was correct and justful.
