Strict RBI regulations will soon protect borrowers from harassment
Borrowers facing difficulties with EMI payments will soon experience relief from aggressive collection tactics. Reserve Bank of India officials have established strict guidelines for loan recovery, aiming to stop harassment by financial institutions and third-party agents. This regulatory shift addresses a long-standing issue in the Indian banking sector where vulnerable citizens often faced severe intimidation during economic downturns. These updated regulations will officially take effect on January 1, 2027.
Strict Boundaries for Collection Agents
Banks and their representatives must now operate within clear boundaries. Collection calls and field visits are restricted to normal daylight hours, specifically between 8 am and 7 pm. Personnel cannot contact individuals during sensitive times like medical emergencies, family bereavements, or weddings. Furthermore, using threatening language or resorting to public humiliation is strictly forbidden. Agents cannot shame defaulters by posting their personal details, photos, or recordings on social media platforms.
Rules for Physical Visits And Privacy
Financial institutions must provide at least one day of advance notice before conducting an initial home visit. Agents must carry proper identification and official authorization documents containing contact details for the bank's grievance officer. Borrowers can choose their preferred meeting location. To ensure accountability, lenders need to record all recovery conversations and keep these audio files for a minimum of six months. Institutions remain fully responsible for the actions of their outsourced agencies.
Regulations on Remote Device Locking
Regulators also established guidelines for remote locking of financed electronics like smartphones and laptops. Lenders can only lock a device if the loan was specifically granted to purchase that exact item. Device restrictions cannot happen immediately after a missed payment. Companies must wait until the account is overdue for at least 30 days before initiating any remote limits. Full device restriction is only permitted after 60 days of non-payment. Even then, essential functions like incoming calls, emergency services, and basic work communications must remain active.
Mandatory Device Restoration Guidelines
Once a borrower clears their pending dues, lenders must restore device functionality within one hour. If a company fails to meet this timeline, they owe the borrower compensation of Rs 250 for every hour of delay. Ananth Shroff, Co-Founder of DPDzero, described these updates as a structural reset for the industry. He noted that while artificial intelligence can help enforce calling windows and monitor language, human empathy remains necessary for dealing with distressed borrowers.
