PepsiCo loses rights to potato variety grown exclusively for Lays

New Delhi, Dec 4: The Protection of Plant Varieties and Farmers' Rights (PPVFR) Authority on Friday revoked a patent for a potato variety grown exclusively for PepsiCo Inc's popular Lay's potato chips. PPVFR, a statutory body set up under the Protection of Plant Varieties and Farmers’ Rights Act, 2001, gave the ruling over a petition filed by farm activist Kavitha Kuruganti, contending that the grant of the certificate of registration to PepsiCo India was based on incorrect information furnished by it. The PPVFR Authority agreed with Kuruganti's contention that Pepsi cannot claim a patent over a seed variety.
