OBC reservation in urban polls: Odisha cabinet approves to amend provisions

Bhubaneswar, Dec 24: Following the direction of the Supreme Court over the reservation of seats for backward classes in urban body elections, the Odisha cabinet on Friday approved to amend the provisions pertaining to reservation of seats of the Chairperson/Mayor in favour of Backward Class Citizens (BCC) in the Odisha Municipal Act, 1950 and Odisha Municipal Corporation Act, 2003. Recently, the Supreme Court struck down 27% reservation for OBCs in local body elections in Maharashtra and Madhya Pradesh citing the absence of empirical data on OBC. The court asked the states to comply with the triple test criteria. The triple test outlined by the Supreme Court includes setting up a dedicated commission to conduct a rigorous empirical inquiry into the nature and implications of the backwardness as regards local bodies within the state, specifying the proportion of reservation required to be provisioned local body-wise according to the commission’s recommendations, and ensuring that reservation doesn’t exceed 50% of the seats reserved in favour of SCs, STs and OBCs taken together.
