Internet use a fundamental right : Supreme Court;directs to review all restrictions in Jammu- Kashmir within a week

New Delhi, Jan 10: Internet use is a fundamental right. Suspension of internet service in Jammu-Kashmir for an indefinite period violates the telecommunication law, said the Supreme Court which disapproved the suspension of internet service in J&K since the abolition of Article 370 of the Constitution. The apex court has directed the J&K administration to provide internet service to the hospitals and educational institutions of the union territory, besides reviewing the imposition of various restrictions in Jammu and Kashmir since August last. The directions were issued by a 3-member division bench of Supreme Court while hearing a batch of petitions filed against imposition of various restrictions in Jammu and Kashmir since the abolition of Article 370. Freedom of speech and internet use is a fundamental right as guaranteed by article 19 (i) of the Indian Constitution, said the Supreme Court bench while issuing a set of directions in respect of Jammu-Kashmir. The government had imposed various restrictions in Jammu and Kashmir on August 5 last year, when the Article 370 was abolished and J &K was accorded an union territory status. Consequently, the residents of Jammu-Kashmir were deprived of a few special benefits. Challenging this, Congress leader Gulam Nabi Azad and many other persons had filed petitions in the Supreme Court. Hearing the petitions, the apex court has given a week's time to the administration to review the imposition of these restrictions. Besides, it has also directed to reactivate all the government and local official websites, because the scope of misuse of websites at these places is minimal.
